Fallout 3 developer Bethesda has been locked in a lawsuit with Interplay, who made the original game and published the second, for some time now, but it looks as though the end of the court action is in sight with exciting results.
The lawsuit has been over Interplay’s intention to make and publish an MMORPG set in the Fallout universe. Since before work on the third game got underway, Bethesda has been in control and ownership of the intellectual property rights.

The results of the lawsuit won’t be made public until next month, but we do know that a settlement’s been made, which can only point to one of two outcomes: either the project’s been stifled for good, or Interplay’s been allowed to continue making a massively multiplayer online iteration of the post-apocalyptic franchise, albeit at some expense.
If the latter’s the case it probably own’t land until 2013 at the earliest, but it’d be a monster success: Fallout 3 sold 610,000 copies in its first month of release. The chance to soak up as many sales again with a monthly subscription thrown in for good measure? It’s a license to print money.
