Apple isn’t having a lot of luck with lawsuits recently. It settled the long running Apple/Nokia patent punch up earlier this month and now it looks like it may fail in its bid to stop Amazon using the term “app store” for the Amazon App Store.
While Apple has thrown piles of documents at the courts, a Calfornian judge is decidely unimpressed by its claims…
At a hearing in Oakland, California, Judge Phyllis Hamilton said she will “probably deny” Apple’s motion to stop Amazon using “app store”. She went on to say she believes Apple has failed to produce “any real evidence of actual confusion” among consumers.
Apple still has the opportunity to offer aditional evidence before the judge rules however and will appeal if the case does not goes its way. It’s engaged in a seperate battle with Microsoft over the same “app store” argument.
