According to documents and news reports filed in a class action against Microsoft in a Sacramento County Superior Court, the company knew in November 2005 that over 50 per cent from the first sales batch were defective.

The case, revealed by US site Daily Games News, further alleges that Microsoft hid this fact in order to fight off the threat of the PS3 and Wii. The case demands all profits Microsoft has made from the Xbox 360 are disbursed and that a refund program for the console is set up in California (where the case is being brought under consumer protection statutes).

Has your 360 failed? Was the fail rate a factor in your console purchase? And do you think us Brits are owed some money from Microsoft too? Let us know…

My Xbox failed recently, but it was fixed quick and Microsoft paid express courier both ways and gave me a months free xobox gold membership. I’m not too bothered about compensation, I only lost a week of game play, no hardship!

I got my PS3 because I was sick of Xboxes dropping dead on me. Then later MS increased the warranty and started rolling out the upgraded chipsets, so I bought another one. This one has never RROD’d (touch wood) but even if it had, I’d have probably stuck with it because in the end, it just has better games. Sorry Sony.

Third time my xbox has been in microsofts hands, getting fairly peeved with it and a replacement is definitely in order now but whether or not I’ll get one is another story.

I have had to send my xbox in 6 times now. The last time I got it back it woirked for one day and then I got the red ring again. Micrisoft will not tell me what is the cause of my red ring and they treat me like I am in the wrong. I feel that to make things better I should get an xbox console that has been upgraded and wont have the red ring. It is a pain in the butt when you have to make sure all your shipping is done according to their standards so they dont get the box and say that it was damaged in transit and then you are assed out of your console. I am fed up with having to send my box back on an average of every six months.

I have had 3 xbox’s in less than 6 months. The 1st one would put big scratches on my disc and the 2nd one got the ring of death after only a month of use. The 3rd seems ok so far but time will tell. I thought these problems were only on older models but that is B.S.

While I love my Xbox360 I have found that I’m ready to move on from the 360. I have had a total of 4 so far. One was in the first batch and they told me that there was nothing that could be done. Then the next 3 pretty much all the same thing. I get the ring of death and I call C.S. and they tell me to unplug the console and try it again. Well that don’t work, when asked if they would fix my systems they told me that it would cost me $150 just to look at it and depending on the problem it could cost up to $300. Not worth my time anymore.

im curious if this lawsuit has any chances of going anywhere close to keeping MS responsible for xbox 360 glitches.
